Marriage and pre-nuptial agreements
Marriage is one of the most important decisions in life, not only in personal but also in legal matters. Not only does it affect the personal status with regard to tax-, but also to inheritance and property law.
If you plan to get married and would like to deviate from the statutory regulations – e.g. the property law provisions,- you may conclude a so-called pre- or post-nuptial agreement.
In the event of a divorce, the prenuptial agreement forms the basis of the property settlement. The prenuptial agreement should always be negotiated individually taking into account the interests of both spouses.
A prenuptial agreement is especially recommended if one of the spouses is an entrepreneur or if the spouses’ financial circumstances differ significantly from one another at the beginning of the marriage.
In addition, a prenuptial agreement is also recommended if one of the spouses gives up a part of or their entire professional career for the family. In such cases, too, an individual solution and protection for the spouse concerned should be considered in advance of the marriage.
